1. The agreement
These Terms are a contract between you and [FILL: Company legal name] (“Creatorfolio”, “we”, “us”), registered at [FILL: Registered address]. They cover creatorfolio.app, public portfolios at creatorfolio.app/@username, and everything else we provide (the “Service”). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you use Creatorfolio for a company, you confirm you can bind that company.
2. Who can use Creatorfolio
You must be at least 16 ([FILL: adjust to your jurisdiction]) and able to form a binding contract. You may not use the Service if we have previously closed your account for breaching these Terms.
3. Your account
- Give accurate information and keep your email current — that is how we reach you about security and billing.
- Keep your password private. You are responsible for activity under your account until you tell us it was compromised.
- One person per account. Team access, if we add it, will have its own terms.
- Usernames are first come, first served, but we may reclaim a username that impersonates someone, infringes a trademark, or has been inactive for 12 months after giving you 30 days' notice.
4. Plans: Free and Creatorfolio Live
Free gives you a full portfolio with every theme and design feature. You add and update posts and stats yourself, and stats you type in are marked self-reported.
Creatorfolio Live is a paid subscription. It connects the TikTok, Instagram and YouTube accounts you authorise, refreshes their public stats, flags Breakout posts and reorders your Shelf automatically. Live depends on those platforms' official APIs. If a platform changes or withdraws access we will do what we reasonably can to restore it, but we cannot guarantee any specific platform, metric or refresh frequency. If a connection stays unavailable for more than 30 days you may cancel and receive a pro-rated refund for the unused period.
5. Billing
- Creatorfolio Live costs $19 per month (plus any applicable taxes), billed in advance to the card you provide through our payment processor. Prices are in US dollars unless shown otherwise at checkout.
- Subscriptions renew automatically each month until you cancel. Cancel any time from the dashboard; access continues to the end of the paid period.
- Refunds: other than the API-outage case above, or where consumer law in your country requires it, payments are non-refundable. [FILL: EU/UK consumers: state the 14-day withdrawal right and how it is waived on immediate access].
- We may change the price with at least 30 days' email notice. The new price applies from your next renewal after that notice.
- If a payment fails we retry and email you. After 14 days of non-payment your portfolio drops back to the Free plan — nothing is deleted.
6. Your content
You own everything you post to Creatorfolio. You give us a worldwide, non-exclusive, royalty-free licence to host, store, resize, display and transmit it only as needed to run the Service — for example to show your portfolio to a brand who opens your link or to generate a share preview. That licence ends when you delete the content or your account, except for copies in routine backups (removed within 35 days) and content others have already shared.
You are responsible for your content. You confirm that:
- you have the rights to post it, including for any music, footage or brand assets in your clips;
- self-reported stats are honest — we mark them as unverified, but misrepresenting them to brands is on you;
- it complies with the rules of the platform it came from and with section 7 below.
7. What you may not do
- Post anything illegal, defamatory, hateful, sexually explicit, or that infringes someone's rights.
- Impersonate another person or brand, or claim posts you did not create.
- Use bots, scraping or purchased engagement to inflate metrics, or attempt to alter how Creatorfolio reads or displays connected data.
- Probe, overload, reverse-engineer or bypass the Service's security or plan limits.
- Use Creatorfolio to send spam or to collect other people's data.
- Resell or white-label the Service without a written agreement.
We may remove content or suspend an account that breaks these rules, immediately in serious cases and otherwise after notice.
8. Connected platforms
When you connect TikTok, Instagram or YouTube you also agree to that platform's terms, including the YouTube Terms of Service and Google Privacy Policy where YouTube is involved. You can disconnect a platform at any time from your dashboard or revoke Creatorfolio's access from the platform's own settings; we then stop reading its data and delete stored tokens.
9. Copyright complaints
If you believe content on Creatorfolio infringes your copyright, email creatorfolio.app@gmail.com with the URL, a description of the work, your contact details and a statement of good faith. We act on valid notices and may terminate repeat infringers. [FILL: US operators: add DMCA agent details registered with the Copyright Office].
10. Our property
The Creatorfolio name, mark, themes, software and design are ours or our licensors'. These Terms give you no right to use them except as part of your portfolio as the Service presents it. Feedback you send us may be used without obligation to you.
11. Ending the agreement
You can delete your account at any time from the dashboard; your public portfolio goes offline immediately and data is removed as described in the Privacy Policy. We may suspend or close your account for breach of these Terms, for non-payment, if required by law, or, with 30 days' notice, if we discontinue the Service. If we close your account without cause we refund any prepaid, unused period.
12. Disclaimers
The Service is provided “as is” and “as available”. We do not promise it will be uninterrupted or error-free, that any platform will keep its API open, or that having a Creatorfolio will win you any deal. To the extent the law allows we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing here limits rights you have as a consumer that cannot be waived.
13. Limitation of liability
To the extent the law allows, Creatorfolio is not liable for indirect, incidental, special or consequential loss, or for lost profits, deals or data. Our total liability for any claim arising from the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim. These limits do not apply to liability that cannot be limited by law, including for fraud, or death or personal injury caused by negligence.
14. Indemnity
If you use Creatorfolio for business, you will cover us against third-party claims and reasonable costs arising from your content or your breach of these Terms.
15. Changes to these Terms
We may update these Terms. For material changes we email account holders at least 14 days in advance and update the date at the top. If you do not agree, delete your account before the change takes effect; continuing to use the Service means you accept it.
16. Governing law and disputes
These Terms are governed by the laws of [FILL: Jurisdiction, e.g. the State of Delaware, USA / England and Wales], without regard to conflict-of-law rules. 17. General
These Terms plus the Privacy and Cookie Policies are the whole agreement. If a clause is unenforceable the rest stands. We may assign this agreement as part of a merger or sale; you may not assign it. Not enforcing a right is not a waiver.
